After Ingram allegedly told a deputy he had illegal drugs at his apartment, investigators found marijuana and bags used to package the drug in a bedroom.

Well, that was bright.

The way to avoid that felony charge is to NOT separate your weed into baggies. That screams "intent to sell". In WV, posession of ANY amount is a misdemeanor, but intent of sale of any amount, even a gram, is a felony.

Know your drug laws, it's basic.

That sounds basic but totally changes the facts of the case. Their intent WAS to sell the dope, they weren't gonna package it any other way. It's not like they were gonna be marijuana dealers and just separate it out from a big ol' bag when the transaction went down. "Hey, wanna buy some weed? Cool, reach into this big bag here and take about $10 worth." Besides, a large part of the "intent to deliver" burden of proof has to do with the amount of the drug being "more than for personal use." If you have either one ziploc bag full of 2 pounds of weed, or 32 small baggies of 1oz each, you'll catch the charge possibly with a few other circumstantial factors thrown in.

Where he goofed up was telling the officers ANYTHING about what was in his apartment. I'm not even sure how this would come up in the conversation.
