How did this not come up in his  background check if the incidents happened prior to his hiring?

I don't believe this is an issue of age.  That would be a sexual assault charge.  This is improper relationship.

I'm looking at Texas Penal Code § 21.12

 

Quote

 

(a) An employee of a public or private primary or secondary school commits an offense if the employee:

(1) engages in sexual contact, sexual intercourse, or deviate sexual intercourse with a person who is enrolled in a public or private primary or secondary school at which the employee works;

 

 

EDIT: if this is about his previous employment at Argyle, then I would not be surprised if further charges come up.
